Case summary

On September 27, 2011, Region 1 filed an administrative complaint alleging that BOSFuel Corporation and Swissport Fueling, Inc., operators of a fuel storage and distribution facility with over 7 million gallons of oil storage capacity at Boston’s Logan Airport, violated Section 311 of the Clean Water Act and the Oil Pollution Prevention regulations at 40 C.F.R. Part 112. EPA’s complaint alleges that the companies could not properly implement a Facility Response Plan as evidenced by an overall “unsuccessful” rating in 2011 after an Government Initiated Unannounced Exercise at the facility. The companies will pay a $90,000 penalty.
