Case summary

Region I settled two Clean Water Act administrative actions against Mayhew Steel Products, Inc. (Mayhew) of Shelburne Falls, Massachusetts. The manufacturer of steel break-bars, chisels, crow-bars, and edge tools violated pretreatment and metal finishing regulations by failing to comply with reporting requirements, discharging zinc above the metal finishing standards, and violating the National Pretreatment Standards’ specific prohibition on discharges of wastewater with a pH lower than 5.0 standard units. Mayhew agreed to a penalty of $157,500 for these violations. In the second action, Mayhew violated stormwater and Spill Prevention Control and Countermeasure (SPCC) plan requirements. The company failed to seek NPDES permit coverage for discharges of stormwater associated with industrial activity in a timely manner and to implement its SPCC.
