Case summary

This is a settlement resolving a Clean Water Act (“CWA”) administrative penalty action against Fabian Oil, Inc. (“Fabian”) for Fabian's alleged failure to maintain and fully implement Spill Prevention Control and Countermeasure (“SPCC”) Plans for three of the company's bulk oil storage and distribution facilities located in Maine. Under the settlement Consent Agreement and Final Order ( CAFO ), Fabian agreed to pay a penalty of $50,000, plus $180 in calculated interest, in three payments. Fabian also certified in the CAFO that it had fully implemented its new SPCC Plans.
