Case summary
On November 8, 2010, EPA issued a Clean Water Act (CWA) administrative compliance order to Germain Bourdeau and his company, Pleasant Acre Farms, LLC for their unpermitted discharge of dredged and fill material into approximately three acres of freshwater wetlands at a farm in Swanton, Vermont. The altered wetlands are located adjacent to an unnamed stream, which flows north into the Missisquoi River, which in turn flows into Lake Champlain, a traditionally navigable water. EPA and the Corps of Engineers have determined that the wetlands at issue are jurisdictional under the CWA. Region Is Rapanos panel was included in that decision-making process.
