Case summary

On July 6, 2011, Region I issued a Notice of Violation and Administrative Order to J.S.B. Industries, Inc. and John P. Anderson, Trustee of 130 Crescent Ave. Realty Trust, for violations of the Clean Air Act’s General Duty Clause, found at Section 112(r)(1) of the Act. The Respondents own and operate a company that makes and freezes baked goods at a facility in Chelsea, Massachusetts. After an ammonia release at the facility resulted in the hospitalization of a fireman, EPA inspected the facility and determined that the facility likely had violated the release reporting requirements of CERCLA Section 103 and the chemical inventory reporting requirements of EPCRA Sections 311 and 312. Upon subsequent review, EPA also determined that the owner and operator of the facility had violated the General Duty Clause because (a) contrary to common industry standards, the facility is designed in a manner that could expose neighbors to ammonia exhaust, and (b) the storage and leaking of oil in the engine room presented a fire risk. The order requires the Respondents to address these problems and to improve its emergency response plan.
