Case summary

Region 1 has filed two Consent Agreements and Final Orders (CAFOs) settling Administrative Penalty Orders that were issued to Hubbard-Hall Inc., for chemical warehouses in Wilmington, MA and Waterbury, CT, on September 29, 2011. At both facilities, the company violated Section 112(r) of the Clean Air Act (“CAA”) by failing to submit a Program 2 Risk Management Plan for hydrofluoric acid (70%). The penalties in the settlements are $56,800 for Wilmington and $63,200 at Waterbury, for a combined penalty of $120,000. Also, Hubbard-Hall will be performing a Supplemental Environmental Project (“SEP”) in connection with the Wilmington facility: purchasing hazardous atmosphere detection equipment for the Wilmington fire department and providing training in its use, at a cost of $10,887. The SEP reduces the cash payment in the Wilmington CAFO to $48,090. These cases arose out of a series of CAA 112(r) inspections that Region 1 has undertaken at chemical warehouse and distribution facilities, which have resulted in numerous enforcement actions over the last two years.
