EPA v. FIRST LAWRENCE FINANCIAL LLC / TOMBARELLO SITE

Case summary

On April 25, 2011, Region 1 signed an Administrative Settlement Agreement and Order on Consent (Settlement Agreement) with a settling party with respect to the Former Tombarello and Sons Property Site, located in Lawrence, Massachusetts (Site). In the Settlement Agreement, the settling party agrees to perform a removal action to address soils contaminated with hazardous substances, including heavy metals and polychlorinated biphenyls, and pay 100% of EPA’s costs for oversight of the removal action. A portion of the Site was historically used as a scrap metal recycling facility, and the following activities were also conducted on that portion of the Site: excavation, screening and magnetic separation of metals from on-site soils located on the Site and operational instruction of tractor-trailer trucks. These activities resulted in the release of hazardous substances at the Site. EPA is also conducting a removal action at the Site to address contaminated soils that are located on certain residential parcels that are part of the Site. The Site is not listed on the National Priorities List. The effective date of the Settlement Agreement is April 26, 2011.
