Case summary
This is an administrative order under Section 309(a) of CWA. Between 2006-2008, respondents Christopher and Bonnie Nash discharged dredged/and or fill material with a section 404 permit into a stream and wetlands at Meredith Farm in Topsfield, MA. The order requires the Respondents to restore alterations to a stream and nearby wetlands. Because Meredith Farm is an active farm, and because a farm pond was constructed for use in irrigating crops (as an alternative to withdrawing water from the stressed Ipswich River), the area in the footprint of the farm pond did not rquire a permit and the farm pond will be permitted to remain.
