Case summary

On January 18, 2011, the Region settled a CWA administrative penalty action against Mt. Tom Generating Company, LLC, a coal-fired steam electric generating facility located on the banks of the Connecticut River in Holyoke, Massachusetts. The facility discharges a variety of wastestreams into the river as well as uses the river as a source of cooling water. Discharges to the river are regulated by the facility’s National Pollutant Discharge Elimination System (NPDES) Permit. Over the last five years, the company’s discharges have exceeded total suspended solids at two of its 11 outfalls. These violations were, for the most part, substantially in excess of permit limits. The company agreed to pay a penalty of $40,814.
