Case summary
Ryezak Oil Co. (Ryexak) of 1536 Route 25, Rumney New Hampshire is a bulk storage facility (Facility) with operations principally consisting of the storage, distribution, and use of oil products. The Facility is located approximately 200 feet overland from a storm drain that empties into the Baker River, a navigable water for Clean Water Act purposes. After inspection, EPA has determined that the Facility failed to fully maintain and implement a Spill Prevention, Control, and Countermeasure (SPCC) plan in violation of Section 311(j) of the CWA, in particular, a lack of adequate secondary containment. Ryezak also failed to responded to a CWA Section 308 information request issued by EPA on June 5, 2009. EPA has issued a Class II administrative complaint proposing a penalty of up to $177,500 for violations of Section 308 of the CWA and the Oil Pollution Prevention regulations.
