Case summary
On February 9, 2011, Region I filed a Consent Agreement and Final Order resolving Clean Water Act violations by Crabtree Development, LLC and R.A. Powell Construction Corp. (Respondents) for discharge of pollutants without a NPDES permit and for failure to apply for coverage under the NPDES Construction General Permit in connection with construction of a residential development in Ayer, Massachusetts. An EPA inspector observed storm water running off the site that contained sand, dirt, sediment, suspended solids, residues of construction material, and turbidity. In the settlement, Respondents will pay a penalty of $27,500. Crabtree, the site owner, will perform a supplemental environmental project.
