EPA v. ESTATE OF AMILIO ZOMPA / BIRCH SWAMP RD

Case summary

On November 9, 2012, the U.S. Department of Justice filed a complaint in U.S. District Court on behalf of EPA against the Estate of Amilio Zompa, and against Cynthia A. Toolin and Francis M. Perna, as Co-Executors of the Estate of Amilo Zompa under Section 107(a) of CERCLA to recover EPA's past costs to remediate the Birch Swamp Road Site, located in Warren, RI. Amilio Zompa owner the Site property at the time of his death in 2008. From August to December 2008, EPA conducted a removal action at the site, where it removed soils contaminated with hazardous substances, including, but not limited to PCBs and lead. 03/25/14: Consent Decree resolving liability of Estate of Amilio Zompa uder Section 107(a)(1) of CERCLA and liability of Defense Logistics Agency under 107(a)(3).
