Case summary
On April 8, 2011, Region I settled an administrative penalty case against Burnham Associates, Inc. of Salem, Massachusetts for violations of the Marine Protection, Research and Sanctuaries Act (MPRSA-commonly referred to as the Ocean Dumping Act). EPA had filed an administrative complaint alleging 28 disposals of dredged material in the wrong location in the Massachusetts Bay Disposal Site (MBDS). As stated in the administrative complaint, the dredged material in this case was from Hingham Harbor and authorized by an USACE general permit to be disposed of at specific coordinates within a two-mile diameter in the MBDS. Hingham contracted with Burnham to perform the actual dredging and disposal. Burnham has agreed to pay $105,000 to resolve EPAs MPRSA claims.
