EPA v. FIVE ACRE FARMS

Final Order With Penalty

Case summary

On November 27, 2008, approximately 60 gallons of heating oil were discharged from an AST at the Five Acre Farm Greenhouses facility. The Spill was discovered by MA DEP. The spill material leaked from an AST to the gravel ground surface beneath the tank. Due to the grade, some portion of the fuel migrated over the gravel surface and into a nearby storm drain catch basin, through subsurface connection piping and subsurface discharge piping, and into to the wetlands/surface water body at the discharge location. There were no reports of environmental harm as a result of the discharge.
