Case summary
This action involves TSCA violations related to spills of polychlorinated biphenyls (PCBs), and the presence of PCBs in hydraulic fluid in freight elevators at the Rhode Island Mall in Warwick, Rhode Island. An environmental site assessment conducted by a prospective purchaser discovered PCB spills in the Malls elevator pits, and subsequent sampling demonstrated PCB concentrations above 50 parts per million in the elevator hydraulic fluids. On July 14, 2008, EPA offered Respondent the opportunity to expedite settlement of the action. On September 15, 2008, EPA filed a CAFO that initiated and concluded this action. Pursuant to the CAFO, Respondent agreed to pay a penalty of $36,100, and complete cleanup of PCB spills in the elevator pits at the Rhode Island Mall.
