Case summary
Case against Severino Trucking Co., Inc. (Severino) and the City of Dover, NH (Dover) for violations of Sections 301(a) of the Clean Water Act (CWA). Severino and Dover are the operators of a sand and gravel pit in Dover, New Hampshire. Although the site was designed for storm water to be wholly contained on-site, a small berm was dug along the access road which directed water away from the pit and towards the Bellamy River. Severino later removed the berm and regraded the area to direct storm water flow into the pit as originally intended. Neither Severino nor Dover obtained a permit for the discharge of storm water to the Bellamy River.
