EPA v. STEPHEN LOWE
Case summary
In September 2007, EPA issued an information request letter to Mr. Lowe to obtain information about excavation work that he conducted at a 68 acre site located in Hubbardston, Massachusetts. During an EPA inspection at the site, Mr. Lowe informed inspectors that there was no federal storm water permit or storm water pollution prevention plan for the activities at the site. Mr. Lowe's response to the information request was due no later than October 21, 2007. To date, Mr. Lowe has not provided a response to the information request. The information requested in EPAs information request is necessary to evaluate Mr. Lowes compliance with the Clean Water Act. The Complaint proposes that the statutory maximum Class I penalty of up to $32,500 be assessed against Mr. Lowe for the violation.
