Case summary
The Town appealed the phosphorus limit contained in its 2006 NPDES permit. This order settles the appeal and requires the town to try and optimize its current treatment facility in order to meet the 2006 pemit limits for phosphorus. If the town cannot meet the limits by optimization the order contains a schedule for the town to design and upgrade the treatment plant. if this is the route choosen compliance with the phosphorus limits is to be accomplised by November 1, 2011 for the winter limits and April 1, 2012 for the summer phosphorus limits.
