Case summary

On January 9, 2008, EPA Region 1 filed a complaint against Butler, Maxcy & Heath, Inc. (“Butler”) as a result of EPA's determination that the company had violated Section 308 and Section 311 of the Clean Water Act and the Oil Pollution Prevention regulations at 40 CFR Part 112. Specifically, the first count of the Complaint alleges that Butler failed to respond to a 308 letter request for information. The second count alleges that Butler failed to prepare and implement a spill prevention control and countermeasure plan for its facility in Union, Maine. The Complaint proposes that a penalty of up to $157,500 be assessed against Butler for these violations. 07/07/2009: EPA is not pursuing enforcement of the default order at this time.
