Case summary

On August 2 and 3, 2006, Region 1 conducted a RCRA compliance evaluation inspection of Respondent’s facility as part of OES's marina/boatyard initiative. As a result of the inspection and other information, Region 1 has determined that Respondent violated Sections 3002, 3010, and 3014 of RCRA, 40 C.F.R. Parts 262 and 279, the corresponding state statutory provisions, and the state regulations implementing these statutory provisions. Specifically, Region 1 has determined that Respondent failed to: notify EPA of its hazardous waste activities; make hazardous waste determinations; ensure employees were thoroughly familiar with proper hazardous waste handling procedures; conduct weekly inspections of hazardous waste storage areas; have adequate secondary containment for hazardous waste containers; meet certain emergency preparedness requirements; mark containers with the words “hazardous waste”; mark containers with accumulation start date; and separate incompatible wastes.
