ALTHOUGH DERECKTOR SHIPYOARD CONN LLC STORES OIL IN AMOUNTS ABOVE THE THRESHOLDS REQUIRING THE PREPARATION AND IMPLEMENTATION OF A SPCC PLAN UNDER 40 C.F.R. PART 112, IT IDID NOT HAVE AN SPCC PLAN. BECAUSE OF TGHE RELATIVELY SMALL QUANTITY OF OIL STORED AT DERECKTOR SHIPYARD CONN LLC (3,175 GALLONS OF ABOVE GROUND STORAGE CAPACITY), DERECKTOR SHIPYARD LLLC, EPA IS UTILIZING THE ESA ENFORCEMENT TOOL.
