IN ADDITION, NOVA VIOLATED CERCLA WHEN IT FAILED TO IMMEDIATELY REPORT A RELEASE OF HAZARDOUS SUBSTANCE IN 2004. THE CASE STEMMED FROM A MARCH 2004 INSPECTION OF THE PLANT FOLLOWING AN ACCIDENTAL RELEASE THAT JANUARY OF 4500 POUNDS OF STYRENE, A HAZARDOUS SUBSTANCE.
