EPA v. SOUTH MUNICIPAL WATER SUPPLY SUPERFUND SITE

Case summary

07/1/2015: On June 23, 2015, EPA signed a Settlement and Third Modification to the Administrative Order for Remedial Design and Remedial Action (RD/RA) for the South Municipal Water Supply Well Superfund Site in Peterborough, New Hampshire. EPA issued a Unilateral Administrative Order to New Hampshire Ball Bearings, Inc. and Minebea Co., Ltd. (collectively NHBB) on June 19, 1990 (Order) to conduct the RD/RA for the Site pursuant to the Record of Decision (ROD) issued on September 27, 1989. EPA issued the First Modification to the Order on September 17, 2012 to reflect an amendment to the ROD for the Site. EPA issued the Second Modification to the Order on May 23, 2013. NHBB has been performing the remedial action without incident. Under the Order, NHBB has paid oversight costs to the Hazardous Substances Superfund. This Settlement and Third Modification to the Order changes the payments from the Superfund to the South Municipal Site Special Account for future use at the Site per agreement of the parties
