THE FILL WAS PLACED WITHOUT AUTHORIZATION OF AN ARMY CORPS OF ENGINEERS PERMIT REQUIRED BY SECTION 301(A) AND 404 OF THE CWA. THIS VIOLATION WAS DISCOVERED IN 1985 BUT THE VIOLATION WAS NOT CORRECTED AFTER ORDERS FROM THE CORPS. EPA SENT AN ADMINISTRATIVE ORDER TO DEFENDANTS TO CORRECT THE VIOLATIONS AND THE ORDER WAS VIOLATED. NOW THE REGION IS REFERRING THE CASE TO SEEK A CIVIL PENALTY AND WETLANDS RESTORATION.
