§ 146.2 Definitions.

For purposes of this part 146:

Commission(a) The term means the Commodity Futures Trading Commission;

Executive Director(b) The term refers to the executive level staff official appointed pursuant to section 2(a)(5) of the Commodity Exchange Act.

FOIA compliance staff(c) The term refers to the Freedom of Information Act compliance staff assigned to respond to requests for information under the Freedom of Information Act;

individual(d) The term means a citizen of the United States or an alien lawfully admitted for permanent residence;

maintain(e) The term includes maintain, collect, use, or disseminate;

record(f) The term means any item, collection, or grouping of information about an individual that is maintained by the Commission, including but not limited to, his education, financial transactions, and criminal or employment history and that contains his name, or the identifying number, symbol, or other identifying particular assigned to the individual;

system of records(g) The term means a group of any records under the control of the Commission from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual;

system noticeFederal Register(h) The term means a notice of the existence and character of the Commission's system of records published in the pursuant to § 146.11(a) of these rules;

routine use(i) The term means, with respect to the disclosure of a record, the use of that record for a purpose which is compatible with the purpose for which it was collected;

Freedom of Information Act(j) The term encompasses both the Freedom of Information Act, as amended, 5 U.S.C. 552, and the Commission's rules contained in part 145 of this title.

agency(k) The term means any executive department, military department, Government corporation, Government controlled corporation or other establishment in the Executive branch of the Government or any independent regulatory agency.
