Syllabus

<p>Money Received — Fraud — Notice — Evidence — Sueeiciency. Where a bank, holding a forged note and mortgage as collateral, had notice that their genuineness was denied, and received part of the purchase money when the owner sold the collateral and procured the bank to assign the same to the purchaser, who relied on the genuineness of the note and mortgage, the bank is liable to the purchaser for the money received by it in the transaction.</p>
