Syllabus

Per Osowik, J., the trial court did not err in granting summary judgment for State Farm. The plain language of the contract prohibited settling without written consent and this provision was clearly violated when three of the plaintiffs signed a release with the tortfeasor and her insurance. Additionally, plaintiffs offer no evidence to contradict the presumption that State Farm was prejudiced by this breach. Accordingly, we affirm the February 26, 2025 Judgment Entry of the Huron County Court of Common Pleas.
