Syllabus

<p>1. Carriers. Ejection of passengers. Intoxication. Laws 1910, chapter 211.</p> <p>Under chapter 211 of the Laws of 1910 providing for the ejection of passengers by the conductor from a passenger train, where such passenger is intoxicated, etc., to justify the conductor in such ejection, it is not necessary that the passenger should be so much under the influence of intoxicating liquors as to be mentally and physically incapable of taking care of himself.</p> <p>2. Same.</p> <p>The statute was designed not for the protection of the person intoxicated, but of the other passengers on the train, and a person intoxicated to the extent that he is mentally and physically incapable of taking care of himself is very much less liable to annoy and endanger the other passengers than one who is less intoxicated.</p>
