Syllabus

<p>(a) Wooden water-pipes, for the price of which suit was brought, were furnished to the defendants by the plaintiff, under a written contract setting forth that he had examined the premises, and warranted said pipes “to stand the hydraulic pressure of the works as it is now graded and constructed: ”</p> <p>1. There being evidence that the pipes were defective and useless for the purpose intended, and that notice had been given the plaintiff to remove them, it was not error to charge that plaintiff could not recover unless the jury found from the evidence that he had substantially complied with his contract.</p>
