Syllabus
The plaintiff appealed from the judgment of the trial court dismissing her action against the defendants for damages arising from her ejection from a residence during the enforcement of a summary process execution for possession. During the pendency of the appeal, the parties entered into a settlement agreement, and the trial court granted the defendants' motions to enforce the agreement, from which the plaintiff filed an amended appeal. She claimed, inter alia, that the court improperly granted the defendants' motions because the draft settlement documents the defendants submitted to her did not reflect material aspects of the parties' agreement. Held: The trial court properly granted the defendants' motions to enforce the settlement agreement, as any dispute as to purported deficiencies in the draft settlement documents was immaterial to the formation of the settlement agreement, and, thus, this court affirmed the judgment of the trial court dismissing the plaintiff's action.
