<p>Negligence. Excavations. Guarding. Res ipsa loquitur..</p> <p>Under the facts disclosed in this case the court held that the doctrine of “res ipsa loquitur” did not apply, as the ditch in question was entirely obvious to the eyes of all, and was not a menace to man or beast under- ordinary circumstances, and the most thoughtful and careful constructor could not have foreseen and provided against the accident for which suit was brought.</p>
