Syllabus

<p>Vendor and vendee — Dispute as to title — Interest on purchase money.</p> <p>If the vendor of real estate cannot make title at the time appointed for the payment of the purchase money, and the vendee takes and retains possession, the latter must pay interest as a compensation for the profits he is receiving pending the determination of the question of title in the vendor's favor.</p>
