Syllabus

<p>Affidavit of defence — Foreign judgment.</p> <p>In a suit upon a foreign judgment, an affidavit of defence is sufficient which avers that no personal service was ever had on the defendant, that the judgment was fraudulent, and that the defendant never appeared in the suit until after judgment was entered, and then only for the purpose of having the judgment set aside on the ground of fraud.</p>
