<p>1. Statute oe Frauds — Promise to Pay Debt oe Another. — A verbal promise of the mayor of a city to pay for a lot of lumber furnished a contractor, who was building a city hall, under contract to furnish all materials, under the statute of frauds cannot bind either the mayor or city to pay the debt.</p> <p>2. Assignment. — To establish an assignment of a fund to become due, it must be shown that the alleged acceptor had notice of the assignment before payment to the assignor.</p>
