Syllabus
<p>In an action on an undertaking executed to release property from attachment, the complaint should allego that the property attached was released upon the delivery of the undertaking.</p> <p>A failure to do so is fatal, and the defect may ho taken advantage of by demurrer, on the ground that the complaint does not state facts sufficient to constitute a cause of action.</p>
