<p>1. A finding of fact by referee and. Circuit judge approved.</p> <p>2. A note and mortgage given by a wife for the amount of a debt due by her husband, in consideration of her release from arrest and imprisonment under a charge of selling goods covered by a lien without notice, and of a discontinuance of such criminal prosecution, are illegal, and in action brought by her, the note and mortgage were ordered to be canceled and surrendered.</p>
