Courts—City Court of New Orleans— Depositions — Nonresidents — Order for Commission.</p> <p>Article 436 of the Code of Practice, requiring an affidavit of materiality as a condition precedent to the granting pf an order for a commission to take the testimony of nonresident witnesses does not apply to proceedings in the city court of the city of New Orleans.</p> <p>2. Same.</p> <p>The city courts of the city, of New Orleans, where not otherwise provided, are governed by the rules of proceeding regulating the practice in justice of the peace courts.</p> <p>(Syllabus by the Court.)</p>
