Syllabus
<p>Landlord and Tenant (§ 150*) — Repairs to Building — Liability op Landlord.</p> <p>Plaintiff leased from defendant for a retail clothing store a building on Rampart street. The front of the lower story on Rampart street was made of plate glass. The plate glass was broken at night by burglars. The lessee notified Bonart of that fact, and called on him to replace the front. On his refusal to do so, AVeil replaced the front at what is conceded to have been a reasonable sum. He then brought suit against his lessor for reimbursement of the amount so expended. The lower court rendered judgment in 'his favor, but the Court of Appeal on appeal reversed the judgment.</p> <p>Held, that the judgment of the Court of Appeal was erroneous, and that of the lower court was correct. ;</p> <p>(Syllabus by the Court.)</p>
