Syllabus

<p>(a) The plaintiffs in assumpsit showed that they had confessed to the defendant a judgment absolute for an amount certain, in consideration of the defendant’s parol agreement to sell plaintiffs’ property, pay all their debts and convey certain real estate to them, which agreement he had refused to perform:</p> <p>1. In such case, the judgment remaining unopened and unreversed, the plaintiffs were estopped from alleging that it did not represent an actual indebtedness evidenced by it, and it was therefore not error to enter judgment of compulsory nonsuit.</p>
