Warnsey Wiggins v. Edward Pianka
Syllabus
The respondent appealed from a final judgment confirming an arbitration award in favor of petitioner. The respondent contended that the award should have been vacated because it was procured by corrupt or undue means, the award was irrational, and the arbitrator had committed misconduct. The Supreme Court determined that respondent was unable to overcome the formidable burden necessary to defeat the presumption of validity to which an arbitration award is entitled. The Supreme Court held that respondent simply disagreed with the arbitrator's decision and failed to provide any evidence to establish any of the factors outlined in G.L. 1956 § 10-3-12 that would warrant vacating the award. Accordingly, the Court affirmed the judgment of the Superior Court.
