<p>Trespass — Wrongful cutting of timber — Conflicting evidence — Case for jury.</p> <p>In an action to recover damages for the wrongful cutting of timber where the determination of controlling questions of whether the title and possession of the land in dispute were in the plaintiff or defendants, depends upon questions of fact to be found from both documentary and oral testimony, the case is for the jury and a verdict and judgment for the defendants will be decisive.</p>
