Syllabus
The plaintiff appealed from the judgment of the trial court denying his motion to open the judgment of dismissal rendered for the defendant. The plaintiff claimed that the court abused its discretion in denying his motion to open. Held: The trial court did not abuse its discretion in denying the motion to open the judgment, as the court reasonably could have concluded that, although an alleged calendaring mistake by the plaintiff's counsel led to the plaintiff's absence from the hearing on the motion to dismiss, it did not excuse the plaintiff's failure to respond to the defendant's motion to dismiss in the previous three months, well beyond the thirty day time period specified in our rule of practice (§ 10-31 (a)).
