<p>Syllabus.</p> <p>1. Under the orders of the foreman in charge of the construction of defendant, company’s line in the held, an accident happened to plaintiff who was not himself at fault.</p> <p>2. In bracing and straightening a cable pole, too much power, under the orders-of the foreman, was brought to bear upon it, causing it to break and defendant to fall.</p> <p>3. The employment of men to work under the foreman was virtually in the latter’s control. lie had employed the plaintiff. Held, That he was not the-fellow servant of the plaintiff.</p>
