<p>Syllabus.</p> <p>Even gross contributory negligence on the part of plaintiff will not defeat Ms right to recover damages if by the exercise of ordinary care the defendant might have avoided the loss.</p> <p>The violation of a city ordinance is not necessarily proof of neg- ■ ligence and does not change the rule of law stated above.</p>
