Syllabus
<p>Criminal laio — Indictment—Several counts: Under the first subdivision of section 1024 of the Revised Statutes, several counts for adultery and fornication may be joined in the same indictment where they relate to the same act and are used for the purpose of meeting the proofs at the trial.</p> <p>Same — Repugnancy: An indictment will not be quashed because of inconsistency between the allegations of several counts in an indictment where they all relate to the same act or transaction and have been varied to meet the proofs as they may develop.</p>
