<p>1. Patents (§ 310*)—Suit for Infringement—Pleading.</p> <p>The failure of the answer in a suit for infringement, in pleading prior use, to state the place of such use, as required by Rev. St. § 4920 (U. S. Comp. St. 1901, p. 3394)', is ground for exception for insufficiency under equity rule 61 (29 Sup. Ct. xxxii) and, if not excepted to or otherwise objected to in the trial court, the objection is waived.</p> <p>[Ed. Note.—For other cases, see Patents, Cent. Dig. §§ 507-540; Dee. Dig. § 310.*]</p> <p>2. Patents (§ .324*)—Suit for Infringement—Issues in Appellate Court.</p> <p>In determining the validity of a patent in an infringement suit, an appellate court is not limited by the scope of the decision of the court below, but will consider all matters material to the question of validity.</p> <p>[Ed. Patents (§ 167*)—Process Patent—Construction of Claims—“Substantially as Set Forth.”</p> <p>The words “substantially as set forth” at the end of a claim in a process patent have the effect of importing into the claim the particulars of the specification relating to the process to illustrate its operation, but not the function or operation of the mechanism there described, nor can they extend the patent beyond the claim which bounds the patentee’s rights.
