Syllabus

<p>Syllabus.</p> <p>The burden of proof lies with the party who is the most cognizant of the facts necessary to decide an issue. Thus where plaintiff locates his property in defendant's possession, the burden of proof is upon the latter to account for his failure to produce it.</p> <p>A typewriter sent by a merchant to a prospective buyer on trial is not subject to the lessor's privilege.</p>
