Syllabus

<p>Contracts — Physician—Fee of consulting physician.</p> <p>A consulting physician who has been called in by an attending physician with the assent of the patient, is entitled to recover his fee from the patient; and this is the case although he may have made a mistake in judgment in diagnosing the case at the consultation.</p> <p>Where a party knowingly and without objection, permits another to render service for him the law implies a promise to pay what the service is reasonably worth.</p> <p>The implied contract of the physician is not to cure, but to treat with care and reasonable diligence and skill.</p>
