Syllabus

<p>1. Death by Wrongful Act — Contributory Negligence — Proximate Cause.</p> <p>In an action for death by wrongful act, an instruction that the defense of contributory negligence will not avail if defendant, by the exercise of reasonable care, could have avoided the accident, correctly states the law, and is not objectionable as being too broad or misleading.</p> <p>¶ 1.
