Syllabus

<p>Where testamentary capacity at the time of making a will is undoubted, and the will is drawn by a sorivener of the’ testator’s own selection, ins the presence of the testator and of the attesting witnesses and in the absence of the beneficiaries, the undue influence, however used, which will avoid it, must be such as destroyed the free agency of the testator at the time and in the very act of making the testament; solicitations, however importunate, cannot of themselves constitute such undue influence.</p>
